T-1. Agreement
These Terms are an agreement between you and Vayuh LLC, a Texas limited liability company (“Vayuh”, “we”, “us”), covering the Vayuh app and related services (the “Service”). By signing in or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don’t agree, don’t use the Service.
T-2. Who can use Vayuh
You must be 18 or older and able to enter a binding contract.
You can’t use Vayuh if:
- you’re barred from receiving services under applicable law, including U.S. export-control and sanctions laws;
- you’re in a country or region subject to comprehensive U.S. sanctions.
T-3. Your account
- You sign in with a Google account. Keep it secure. You’re responsible for activity under your account.
- One account is for one person.
- You can delete your account at any time (Settings › Delete Account, or www.vayuh.app/delete-account). See the Privacy Policy for what is deleted and when.
T-4. Flight information: what Vayuh can and can’t promise
Flight times, gates, statuses, airport delays and weather in Vayuh come from airlines, airports and other third-party data providers. That information can be late, incomplete or wrong, and alerts can be delayed or not arrive. Vayuh doesn’t control it and doesn’t guarantee it. Always confirm with your airline and airport before you act, especially about boarding, gates, connections and cancellations.
Vayuh is a personal travel aid. Don’t use it for navigation, aviation operations, air traffic or airport operations, or any decision where a mistake could cause injury, death or damage to property.
Estimated times are estimates. Notifications depend on your device’s settings, battery and network, and on Google’s delivery service.
T-5. Using Vayuh fairly
Vayuh is for your personal, non-commercial use. You agree not to:
- copy, scrape, resell, redistribute or publish flight data from Vayuh, or use it to build a competing product or dataset;
- use bots, scripts or any automated means to access the Service, or interfere with its security features (including Firebase App Check), its servers or other users’ accounts;
- reverse-engineer, decompile or modify the app, except where the law allows it despite this restriction;
- use Vayuh or its data for betting, wagering, prediction markets or event contracts;
- use Vayuh for navigation, aviation or airport operations, or any safety-critical purpose;
- use Vayuh to stalk, harass or surveil anyone, or for any unlawful purpose.
We may suspend or end access for anyone who breaks these rules. Where it’s practical and lawful, we’ll tell you why first.
T-6. Third-party services
Vayuh works with services we don’t control, each under its own terms:
- Google sign-in;
- Google Calendar, if you connect it;
- Google Play, for downloads;
- Firebase Cloud Messaging, for notifications.
Your use of them is governed by those terms.
T-7. Ownership and licence
- Our app: we own the Vayuh app, its design and content. While you follow these Terms, we give you a personal, non-transferable, revocable licence to use the app on devices you own or control.
- Flight data: it belongs to its providers and their licensors. You get no rights in it beyond viewing it in Vayuh for personal use.
- Trademarks: airline and airport names and logos shown in Vayuh are trademarks of their owners. They identify the airline, and their display doesn’t mean the owner endorses Vayuh.
- Open-source components: these are licensed under their own licences.
- Feedback: if you send us suggestions, we may use them without owing you anything.
T-8. Disclaimers and limits on liability
8.1 Except where the law doesn’t allow it, the Service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy and uninterrupted availability.
8.2 To the extent the law allows, we aren’t liable for:
- indirect, incidental, special or consequential losses;
- missed flights or connections, travel costs, or lost profits or data;
- anything caused by third-party data, networks or devices.
8.3 Our total liability for all claims is limited to US$50.
8.4 Nothing in these Terms limits liability that can’t legally be limited, such as for death or personal injury caused by negligence, or for fraud. It doesn’t affect your statutory rights as a consumer, including those in the EEA and UK.
T-9. Ending the agreement
You can stop using Vayuh and delete your account at any time.
We may end or suspend your access if you seriously or repeatedly break these Terms, or if the law requires it. If we end the Service as a whole, we’ll give you reasonable notice.
T-10. Changes
We may change these Terms. For material changes, we’ll give you notice in the app or by email at least 30 days before they take effect. If you keep using Vayuh after that, you accept the new Terms. If you don’t accept them, stop using Vayuh and delete your account.
T-11. Governing law and disputes
The laws of the State of Texas govern these Terms. Disputes go to the state or federal courts in Travis County, Texas, but you may bring a claim in small-claims court where you live.
EEA, UK and Swiss consumers: you keep the protection of the mandatory laws of the country where you live, and you may bring claims in its courts.
T-12. General
These Terms and the Privacy Policy are the whole agreement between us about the Service.
- If any part is unenforceable, the rest stays in effect.
- If we don’t enforce a term, we haven’t waived it.
- You may not transfer these Terms. We may transfer them as part of a merger, acquisition or sale of assets.
